1 ACCEPTANCE OF TERMS

Information produced by us on how to enter the Awards and prizes for the Awards winners (including information on our website) forms part of these Terms. By submitting your entry to the Awards, you are deemed to accept these Terms. We reserve the right, in our sole discretion and at any time, to replace or amend these Terms or to modify, suspend, terminate or cancel the Awards.

2 ELIGIBILITY

2.1 Except as set out at 2.2 and 2.3 below, the Awards are open to New Zealand residents, who are at least 16 years old.
2.2 You are not eligible to enter the Awards if you are our employee, an employee of any company associated with the Awards, or an immediate family member of such employees.
2.3 Acting reasonably, we may exclude any person from entering into the Awards.

3 ENTRY

3.2 To enter the Awards, you must submit your entry to us via our website located at [URL] (“our website”). To be valid, an entry must be completed in full, including providing the answers and information regarding you and your employer. Our website includes further information on how to complete your Awards entry and what other information we require you to submit.
3.3 Entries must be received by [5.00 pm] on the deadline date specified in our website. We cannot accept responsibility for any lost, misplaced, illegible, damaged, stolen, late or incomplete entries.
3.4 Upon receipt, all entries and submitted materials become our property. By entering the Awards you hereby:
(a) grant to us full rights to use your submitted materials (and any reproductions, manipulations and adaptations thereof) and the intellectual and other rights therein (“Rights”) for any purpose and in any media including the internet, in each case without compensation;
(b) acknowledge and agree that we may use your name, detail and submitted materials for promotional and media purposes, and you will participate in any publicity arrangements which we reasonably require, in each case without compensation;
(c) confirm that you are the sole legal and beneficial owner of the Rights, or you have the express written consent of the true legal and beneficial owner, and that the exercise of the Rights will not violate any law or infringe the rights of any other person;
(d) confirm that, where the Awards entrant is under 16 years old, the consent of that person’s parent or guardian has been obtained. Failure to demonstrate such consent to our satisfaction may result in your entry being invalid, disqualified and any prize awarded to you being forfeited.

4 PRIZES

4.1 We may publish details of the Awards prizes on our website, as updated from time to time.
4.2 Prizes cannot be redeemed for cash, and cannot be transferred or exchanged.
4.3 If a prize is not available for any reason, we reserve the right to substitute the prize with another prize of similar value. We cannot accept responsibility for the cancellation or postponement of any prize (in whole or in part).
4.4 Each prize is taken entirely at the prize winner’s own risk. We will not be liable for any loss, damage or injury (including but not limited to any indirect or consequential loss) suffered or incurred by you or any other person as a result of or in connection with the Awards or any prize, except for any liability which cannot be excluded by law. You release and indemnify us and any persons affiliated or associated with the Awards in respect of any claim for any accident, injury, death, property damage and other losses that may occur in connection with the Awards or any prize.
4.5 The winner of a prize is responsible for any tax or other costs arising in relation to, or associated with, the prize. Where the prize is a trip, the trip must be taken by the date we notify to you, and excludes meal and beverage costs, airport or hotel transfers, room upgrades, personal insurance, medical expenses, spending money, passports and visas (if required) and other ancillary costs.
4.6 Certain prizes may be subject to additional terms and conditions, and you must accept and abide by such terms and conditions (and all other requirements) in order to redeem and enjoy such prizes. For instance, the Bonfire® Card is subject to card fees and separate terms and conditions.

5 WINNING

5.1 We will assess all valid Awards entries, to determine a short-list of entries in each Awards category. The short-list will then be further assessed by an independent judging panel against relevant judging criteria, to determine in each Awards category the finalists and the winner.
5.2 We will notify the Awards finalists and winners by phone, email or post, using the details on the entry forms.
5.3 We may refuse to award any person who has, in our view, acted in a fraudulent manner, breached these Terms or gained an unfair advantage in participating in the Awards.
5.4 Our determination of the Awards finalists and winners will be final and binding, and no correspondence or other communication will be entered into.

6 YOUR PRIVACY

6.1 We respect your privacy rights under the Privacy Act 1993. You authorise us, and other entities involved in the Awards, and our authorised service providers to collect, hold, use and disclose personal information about you (including your name, image and contact details, as well as the content of your Award entry submissions) to conduct the Awards and for future promotional purposes. You understand that you have a right of access to, and may request correction of, personal information held by us about you, which you may exercise by contacting us at [email protected]. Failure to provide the personal information requested in the entry process will result in the entry being invalid.
6.2 [USE FOR FACEBOOK ACTIVATION] You acknowledge and agree that you are providing your information to us and not to Facebook, and that the Awards are in no way sponsored, endorsed or administered by, or associated with, Facebook. To the extent permitted by law, you release and discharge Facebook from any and all liability for our actions, content and information on Facebook associated with the Awards. To the extent that Facebook’s terms and conditions apply to the Awards, by entering the Awards you are deemed to accept all applicable Facebook policies including Facebook’s Data Use Policy (found here – https://www.facebook.com/about/privacy/) and Statement of Rights and Responsibilities (found here – https://www.facebook.com/legal/terms).

7 DEFINED TERMS AND INTERPRETATION

7.1 In these Terms, the following words have the following special meanings:
“Terms” means these Awards terms and conditions (as amended from time to time); “we”, “our”, “us” means Card Works Limited; and “you” means a person entering the Awards.
7.2 For convenience, these Terms have been grouped under different headings, but the headings do not affect the meaning of these Terms.
